Filing a notice
To be valid under § 512(c)(3), your notice must include:
- Identification of the copyrighted work you claim is infringed.
- The URL or exact location of the material on LandLens you want removed (a property page link and the review or photo in question).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.
- Your physical or electronic signature.
On receipt of a valid notice we remove or disable access to the material, notify the user who posted it, and record the notice. Knowingly misrepresenting that material is infringing exposes you to liability under § 512(f). A review that names your property or describes a tenant's experience is not a copyright matter; use the in-app flag or support for those.
Counter-notice
If your content was removed and you believe it was removed by mistake or misidentification, send a counter-notice containing: identification of the removed material and where it appeared; your name, address, phone, and email; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for Massachusetts) and to accept service from the person who filed the notice; and your signature. We forward counter-notices to the original complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.
Repeat infringers
We terminate the accounts of users who are subject to repeated valid notices.
